Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") are a legally binding agreement between you ("you" or "User") and ThatJob ("we," "us," or "our"). By creating an account, accessing, or using the website at thatjob.ai and the related web application (collectively, the "Service"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 16 years old and capable of forming a binding contract under applicable law to use the Service. By using the Service, you represent and warrant that you meet these requirements.
3. Account Registration
To access most features you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to notify us immediately at support@thatjob.ai if you suspect unauthorized use of your account.
4. Subscriptions & Payments
4.1 Plans
The Service offers paid subscription plans (currently "Basic" and "Pro"). Pricing, feature limits, and plan details are described on our Pricing page. We reserve the right to modify pricing with 30 days' advance notice.
4.2 Billing & Renewal
Subscriptions are billed on a recurring monthly basis through Stripe. By subscribing you authorize us to charge your payment method each billing cycle. Subscriptions automatically renew unless cancelled before the end of the current billing period.
4.3 Cancellation & Refunds
You may cancel your subscription at any time through the billing settings in the app or via the Stripe customer portal. Cancellation takes effect at the end of the current billing period — you will retain access until then. We do not provide prorated refunds for partial billing periods. If you believe you have been charged in error, contact support@thatjob.ai within 14 days of the charge.
5. AI-Powered Features & Third-Party Providers
5.1 Nature of AI Output
The Service uses artificial intelligence (currently OpenAI GPT-4o) to generate content such as tailored resumes, cover letters, outreach emails, match scores, and interview preparation questions. AI-generated output is provided on an "as-is" basis. You acknowledge that:
- AI output may contain errors, inaccuracies, or omissions.
- You are solely responsible for reviewing, editing, and approving any AI-generated content before using it.
- We do not guarantee that AI output will achieve any particular result (e.g., securing interviews or job offers).
5.2 Data Shared with AI Providers
When you use AI features, relevant input data (resume content, job descriptions, company information) is transmitted to OpenAI for processing. Please refer to Section 4 of our Privacy Policy for full details on what data is shared, how it is handled, and your choices. By using AI features you consent to this data transmission.
5.3 Third-Party Provider Changes
We may change, add, or remove third-party AI or service providers at any time. We will update our Privacy Policy accordingly and, where the change is material, notify you in advance.
6. User Content & Ownership
6.1 Your Content
You retain all ownership rights in the content you upload or create through the Service (resumes, job data, contact information, etc.). By using the Service you grant us a limited, non-exclusive, worldwide license to process your content solely to provide and improve the Service.
6.2 AI-Generated Content
To the extent permitted by applicable law, you own the output generated by AI features from your inputs. We make no claim of ownership over AI-generated content produced for you. However, similar outputs may be generated for other users who provide similar inputs.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or to violate any applicable law or regulation.
- Attempt to gain unauthorized access to any part of the Service, its infrastructure, or other users' accounts.
- Reverse-engineer, decompile, or disassemble any part of the Service.
- Use the Service to generate spam, misleading content, or content that infringes third-party rights.
- Scrape, crawl, or automated-access the Service beyond what is permitted by our robots.txt.
- Resell, sublicense, or redistribute the Service or access thereto without our prior written consent.
- Circumvent usage limits, subscription gates, or other access controls.
We reserve the right to suspend or terminate accounts that violate these Terms.
8. Intellectual Property
All rights, title, and interest in the Service — including its design, code, trademarks, logos, and documentation — are owned by ThatJob or its licensors. Nothing in these Terms grants you any right to use our trademarks or branding without written permission.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THATJOB, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE (WHETHER DIRECT OR INDIRECT), ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless ThatJob and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights.
12. Dispute Resolution & Arbitration
12.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict-of-law provisions.
12.2 Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures. The arbitration shall be conducted in California. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
12.3 Class Action Waiver
You agree that any arbitration or proceeding shall be conducted only on an individual basis and not as a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than arbitration, you waive any right to a jury trial.
12.4 Exceptions
Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction for matters relating to intellectual property rights or unauthorized access to the Service.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 6, 9, 10, 11, 12, and 14 shall survive termination.
14. General Provisions
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and ThatJob regarding the Service.
- Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
- Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
- Force Majeure: We shall not be liable for any failure to perform due to causes beyond our reasonable control (e.g., natural disasters, acts of government, internet outages, third-party service failures).
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will revise the "Last updated" date at the top and notify you by email or through the Service. Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the changes.
